1. Scope of application

For all deliveries of VOODOO-RITE to consumers (according to § 13 BGB - German law), these terms and conditions are current.

“Consumer” means a natural person who, in transactions covered by this Directive, is acting for purposes which can be regarded as  outside his trade or profession.

2. Contractual Partner

The purchasing agreement is made with VOODOO-RITE - 

(M.Lai) - Guwastr.1-65510 Wallbach (GERMANY). You can contact our customer-service for any questions, revocations etc via E-Mail VOODOO-RITE@GMX.DE OR by using the contact-form above. We are anxious to answer you as soon as possible (mostly on the same day). 

3. Offers and Contracts

3.1 The presentation of products in the online store does not constitute a legally binding offer, but merely an invitation to place an order. Errors reserved.

3.2 By clicking the button "Send order" during the final step of the order procedure, you agree to a binding order of all goods in the shopping cart. The bill of sale/ contract comes about if we accept your order by a confirmation via Email immediately after we receive your order. 

3.3 Contract language and Contract Text Storage

The possible languages available for contract conclusion are German and English.

The contract text is saved on our systems, but these are not accessible for the customer. The customer has always the possibilty to see the last orders by looking at the link "my orders" in his or her personal account.

4. Right of withdrawal/ revocation

4.1 Customers have the following right of withdrawal

Cancellation policy

You have the right to withdraw your contract with us - without indicating reasons - within a period of 14 days. The costs of revocation (in other words the costs of sending back our products), have to be paid by the buyer (customer) him-/herself.

The revocation-period of 14 days is meant to begin at that day, where you or a representing person has taken the last goods into possession.

To execute your right of revocation, you have to inform us in text form (e.g. letter, e-mail). You can use the "Sample-Revocation Form" below. For performing your right of revocation, it is enough to send us that message in text form just BEFORE the period of revocation is expired.

Revocation consequences

In the event of a valid revocation, the performance delivered by either party is to be returned and the proceeds of any utilization (e.g. interest) submitted. If you cannot submit / return the received performance and benefits (e.g. utilization benefits) to us, or submit / return them only partially or in a deteriorated condition, you need to compensate us to the required extent. In the event of a valid revocation, you have to send back our goods as fast as possible (maximal 14 days from that day on, where you informed us about the revocation). You bear the full costs of sending back our goods in the event of a revocation. And if you are a buyer from Germany, please be so kind and use DHL for sending our goods back to us. Secured shipping methods with a tracking-number are always the best to prevent a loss of packages. 

You only have to compensate us for the loss of value if it is the result of an inappropriate use/ handling of our property by yourself.

You do not have the right of withdrawal/ revocation if the goods...

- are not prefabricated and personally/ individually made for the customer after his/ her order

- are likely to decay (for example in relation to their day of expiry)

- are sealed: goods that are not suitable for sending them back because of health protection and hygiene

- consist of unseparably compounded components

Losing the right of revocation in relation to online-services

Your right of revocation is cancelled when you buy services. We are only then able to start with the execution of your order, when you have explicitly agreed that we shall start with it BEFORE the period of revocation is expired. You have to admit that if we shall start with the service you have ordered prematurely, you will lose any right of revocation.

5. Prices and Shipping

5.1 The prices of the products do not include packaging or shipping costs. 

5.2 The individual shipping costs are indicated during the ordering procedure in your shopping cart. In addition to that, you can read more information about this by clicking on the link "Delivery" on the left. Current DHL-prices are our reference point, plus packaging material. The final price of packaging and shipping depends on the weight of your order and the location of your country. 

If your country demands any duty-fees for deliverys from other countries, it is up to you to inform yourself about that. We do not pay any duty-fees of any country we deliver to. 

5.3 § 19 UStG - GERMAN LAW - (no separate 19% VAT included and also not shown on our invoices)

6. Delivery

6.1 Delivery is made with DHL (a German Shipping-Service). Within Germany an order with an value below 25 Euro can be sent via "Deutsche Post-Maxibrief" if it is possible in relation to the weight and size of the products ordered; because of the case of "minimum quantity" we cannot reduce the shipping costs that are calculated by the system, in this situation. 

6.2 Information about the delivery times you can find on each product description. We are zealous to have all the information on a current status. Nevertheless, it can happen that some information is not correct (for example, if a product is marked as being in stock and it is sold out), we apologise for any inconvenience, but we cannot guarantee an unfailing availability. But in any case we are always endeavoured to inform our customers as soon as possible. In this case, payments that have been already made for a product that is not available any more, will be refunded of course. 

7. Payment and Reservation of Ownership

The amount of invoice is the be paid within 7 days after your order. In the event of a default in payment, it is up to us to cancel your order. 

The goods remain our property until complete payment has been made. Before transfer of ownership use as a pledge, as security or processing or transformation without our consent is prohibited. 

8. Warranty

Concerning our products: current German warranty rights are valid.

9. Attention should be paid to any physical or psychic/ mental diseases/ pain:

It is agreed hereby that the customer does not buy our products and services to replace any medical advice or treatment. In the case of physical or psychological (mental) diseases or pain OF ANY KIND, we emphasise hereby that we do not offer any replacement for a medication or a medical advice. It is up to the customer's responsibility to clarify any health problems with his/ her doctor first. We do not assume any liability for any damage caused by an absence of an effect. All the possible effects mentioned in the product descriptions are to be understood as possible tendencies for a completely healthy person. These tendencies (e.g. depending on age, personality and life situation) can be seen or felt in different effectivenesses. 

10. Important conditions concerning the use of our waters and herbs

The customer hereby accepts that he/ she only buys and uses our products that are provided for being used to eat, drink or for being applied to the skin (lotions, baths etc.) if he/ she is not allergic or hypersensitive to them. It is up to the customer's responsibility to be tested concerning possible allergies or other incompatibilities. Products in the categories Gem-Water and colourless Holy Water are in drinking water quality. For our coloured waters we only use food safe colours, but nevertheless, they are not provided for being swallowed (primarily as ritual water/ altar water). Please store them in the fridge and use them within about one month. After a longer period the colour can lose its intensitiy. Be sure not to stain any textiles or valuable objects. In our tests, the coloured waters could be removed from our skin completely after washing with soap. It is up to the customer to prohibite any damage with our coloured waters, we will not assume any responsibility for damages or soilings. Our herbs that are provided to be used as herbal teas are to be consumed on the customer's own authority and responsibility. Not to provoke any hypersensitivity, the customer tests himself/ herself slowly with low doses. If there are any doubts concerning the physical tolerability or any physical complaints, a doctor has to be consulted. This shall especially apply for our Cola Nut (because of the caffeine) and the Potency Wood (both products are for adults only!). VOODOO-RITE shall not assume any liability for a misuse of our products. All our herbs correspond with all legal provisions (German law) and their quality is strictly and constantly controlled. Concerning the LMVI - there are no allergens of that list in our products.

14. Final provisions (severability)

The invalidity of any particular clause, provision or covenant herein shall not invalidate all or any part of the remainder of this contract, but such remainder shall be and remain valid in all respects as fully as the law will permit.
